Identified LLC (“Identified” or “we”, “us,” and “our”), provides the Identified application. Identified is an application designed to ensure that each individual’s dignity and respect is upheld after their death. Identified seeks to ensure correct identification of a body as it moves through the various stages of the complex postmortem system until it ends at its final resting place.
- Scope and Updates to this Privacy Policy
This Privacy Policy applies to personal information processed by us in connection with Identified, or wherever this Privacy Policy is linked. By accessing or using Identified, you signify that you have read, understood, and agree to the Identified Terms and Conditions and to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy. You also acknowledge that once your personal information has been entered, you may no longer be able to access, delete, or modify the personal information you have provided.
Changes to Our Privacy Policy. We may revise this Privacy Policy from time to time in our sole discretion. If there are material changes to this Privacy Policy, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you continue to use Identified after the new Privacy Policy takes effect.
- Personal Information We Collect
We collect personal information mainly to provide you with the services on Identified. The categories of personal information we collect depend on how you interact with us and the requirements of applicable law. We collect personal information from a variety of sources, such as when you provide it to us, information we obtain automatically when you use Identified, and information from other sources, such as third-party services and organizations as described below.
- Identifiers. We may collect identifiers such as your first and last name, email address, username, profile picture, phone number, or address when you register to use Identified.
- Geolocation. We may collect your location information, such as where you live or use Identified.
- Your communications with us. We may collect any personal information that you provide in your communications with us.
- Personal information collected automatically. We may collect certain information automatically when you use Identified, such as your Internet Protocol (IP) address, github address, user settings, MAC address, cookie identifiers, mobile carrier, mobile advertising and other unique identifiers, browser or device information, and Internet service provider. We may also automatically collect information regarding your use of Identified, such as pages that you visit before, during, and after using Identified, information about the links you click, the types of content you interact with, the frequency and duration of your activities, and other information about how you use Identified.
- Information You Provide to Us
We collect information you provide directly to us. For example, when becoming a new customer or creating an account, we collect personal data such as name, email address and phone number. We also require you to upload a photo of yourself which will be used to later identify you. We also collect information which you provide us with such as visual material, messages you have sent us, e.g., feedback, a request in our digital channels or the content of any communications you may choose to send us.
- Information Collected Through Observing the Visual Material You Provide
We collect information from the biometric data which is obtained within the application. Information can include your facial features, identifying characteristics, and other information used to identify you through the application.
- How We Use Your Personal Information
We mainly use your personal information to provide you with access to our services, answer requests for customer or technical support, communicate with you about your account, activities on Identified, and policy changes, and register for other Identified offerings. We may also use your personal information for a variety of business purposes, including to provide you with Identified, for administrative purposes, to collect analytics, and to market Identified. We might also use your personal information for direct marketing, research and development (including marketing research), network and information security, and fraud prevention. Your personal information may also be used to measure interest and engagement in Identified, improve, upgrade, or enhance Identified, develop new products or services, debug, identify or repair errors, enforce or agreements, and policies, and any other activities required to comply with our legal obligations.
- How We Disclose Your Personal Information
We may disclose your personal information (excluding sensitive data, such as face data) in the following ways:
- Service Providers. We may disclose your personal information with our third-party services providers and vendors that assist us. These third-parties may include IT support, hosting, customer service, and related services.
- Business Partners. We may disclose your personal information with our business partners, including those with whom we jointly offer products or services.
- Affiliates. We may disclose your personal information with our company affiliates, such as for our administrative purposes, IT management, or for them to provide services to you or support and supplement Identified.
We may also disclose your personal information with third parties as appropriate and permitted by law. These include to comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our, or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity.
If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction, as permitted by law and/or contract.
- How Long We Retain Your Personal Information
We will retain your personal information for as long as you use Identified, or any Identified products or services, for as long as necessary to fulfill the purpose(s) for which it was collected, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws. Upon conclusion of the purpose(s) stated previously, data deletion will occur after three years or can be initiated sooner by the user or entity legally representing the user.
- Security of Your Personal Information
We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized access, use, disclosure, or loss of personal information.
By providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of Identified. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on our website, by mail, or by sending an email to you.
- Additional Information for U.S. Residents
If you are a resident of certain U.S. states, including California, Colorado, Connecticut, and Virginia, you may have rights relating to your personal data.
Right to access your personal data
You have the right to receive confirmation on whether we process personal data relating to you and the right to access any such personal data. We may ask you to specify your request where necessary, for example with regards to the processing activities to which the request relates.
Right to correct your personal data
You have the right to correct any inaccurate personal data we may maintain about you. Please note that we may provide you with self-service tools that allow you to do this yourself.
Right to opt-out of certain uses of your personal data
You have the right to opt-out of (i) the sale of your personal data, (ii) the share or disclosure of your personal data for purposes of targeted advertising, and (iii) the use of your personal data for profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer. Please note that we do not sell personal data of those under the age of 16.
Right to delete your personal data
You have the right to request erasure of your personal data from our data systems in certain situations. Identified will comply with your request, provided we do not have a legitimate reason not to delete the data, such as a statutory obligation to continue processing the personal data.
Right to limit our use and disclosure of your sensitive personal data.
You have the right to request that we limit our use and disclosure of your sensitive personal data. Please note that we do not currently use or disclose your sensitive personal data beyond what is necessary to provide you with services you have requested, nor do we use your sensitive personal data to infer characteristics about you.
We will not discriminate or retaliate against you if you exercise any of these rights.

If you are an authorized agent wishing to exercise rights on behalf of another person, please contact us using the information in the “Contacting Us” section above and provide us with a copy of the consumer’s written authorization designating you as their agent.
